What we collect when you visit, write to us or give, and the stricter rules we hold ourselves to for anything about the children we work with. A plain summary comes first. The numbered policy below it is the one that binds us.

1Who we are

Bhagya Nepal is a non-profit organisation registered in Nepal and affiliated with the Social Welfare Council (Affiliation No. 59416), based in Panipokhari, Kathmandu. In this policy, “Bhagya Nepal”, “we”, “us” and “our” mean that organisation.

We are responsible for the personal information described in this policy.

2What this policy covers

This policy applies to personal information we collect through this website, bhagyanepal.org, and through the contact and giving routes it describes. It does not cover other websites we link to; those have their own policies.

We follow the Individual Privacy Act, 2075 (2018) of Nepal and its regulations. If you live in another country whose data protection law gives you further rights, we will respect them.

3Information we collect

When you write to us

The form on our Contact page does not send or store anything by itself. It opens your own email app with your message written out, addressed to us: your name, email address, phone number if you give one, the purpose of your message and the message itself. We receive it as an ordinary email once you press send. The same applies if you email us directly.

When you call or message us

If you phone us or message us on WhatsApp, we receive your phone number and whatever you tell us. WhatsApp messages are also handled by WhatsApp, under its own privacy policy.

When you give

Gifts by bank transfer or Fonepay QR go to our account at Laxmi Sunrise Bank Limited. We receive the details your bank includes with the payment, usually your name, the amount, the date and any reference you add. We never see or store your banking credentials.

Gifts by Venmo from the United States go to Carolyn (Callie) Fauntleroy, a member of our Advisory Board, who passes them on to Bhagya Nepal. She sees what Venmo shows her, such as your name, username, the amount and any note, and shares with us only what we need to record the gift. Venmo's own privacy policy applies to the payment.

If you write to us about a gift, we keep that correspondence with the record of it.

When you visit

Like most websites, ours is run by a hosting provider that automatically records basic technical information about each visit: your IP address, browser type, the pages requested and the time of the request. This is used only to keep the site running and secure.

What we do not collect

We do not knowingly collect personal information from children through this website. Information about the children we work with is gathered offline, with guardian consent, and is governed by clause 5 and our safeguarding commitments.

4How we use it

  • To reply to your message and continue a conversation you started.
  • To record your gift and, if you ask, confirm it in writing.
  • To handle a safeguarding concern you raise. A concern is shared only with the people who need to act on it, which can include the authorities where a child may be at risk.
  • To keep the financial and administrative records Nepali law requires.
  • To keep this website secure and working.

We will not add you to any mailing list or send you appeals unless you have asked us to, separately and explicitly. We do not sell, rent or trade personal information, and we do not use it for advertising.

5Children's information and images

Nothing we hold is more sensitive than information about the children we work with. It is held to a stricter standard than anything else in this policy.

Consent first. A child's image, name or story appears on this website only with the informed, documented consent of their guardian, covering website and social media use, and with the child's own agreement.

Many never appear. Many of the children we work with are never shown here at all, and that is their choice.

Withdrawal at any time. A guardian, or the child once grown, can withdraw consent at any time without giving a reason. We remove the image or story from this website within 7 days of the request.

Their words, or none. We do not write words for children. Stories appear in a child's own words or with their approval.

We cannot recall copies other people made before removal. That is why clause 4 of our Terms & Conditions prohibits copying any image of a child from this site.

Records about the children we work with are not kept on this website, and access to them is limited to the people who work directly with those children.

6Cookies and analytics

This website sets no tracking or advertising cookies, and we do not use analytics that follow you across other sites.

Our typefaces are served from our own website, so loading a page does not share your details with a font provider. The security service that protects the site from attacks may set a strictly necessary cookie to tell people apart from automated traffic. It is not used to track you.

7Who we share it with

We share personal information only with organisations that help us run our work, and only as much as each needs:

  • Hosting and security: the companies that host this website, keep its server logs and protect it from attacks.
  • Email: the provider that runs our inbox, which holds the messages you send us.
  • Messaging: WhatsApp, if you choose to message us there.
  • Banking: Laxmi Sunrise Bank Limited and Fonepay, which process gifts made by transfer or QR; and, for Venmo gifts, Venmo and the Advisory Board member named in clause 3.
  • Professional advisers: our auditors and legal advisers, under a duty of confidentiality.

We will disclose information to authorities where the law requires it, or where we believe it is necessary to protect a child from harm.

8Where it is stored

Some of the services in clause 7 store information on servers outside Nepal. Where that happens, we take reasonable steps to make sure it is protected to the standard this policy describes.

9How long we keep it

  • Messages: up to two years after the conversation ends, unless they relate to a gift or a safeguarding concern.
  • Records of gifts: as long as Nepali accounting and tax law requires.
  • Safeguarding records: as long as our safeguarding policy and the law require.
  • Server logs: only as long as our host needs them to keep the site secure.

When information is no longer needed, we delete it or make it anonymous.

10How we protect it

This website is served over an encrypted connection. Access to personal information is limited to the people who need it, and records about children are held with tighter access still. No system is perfectly secure. If a breach affects your information, we will tell you, and the relevant authority where the law requires, without undue delay.

11Your rights

You can ask us to:

  • tell you what personal information we hold about you, and give you a copy;
  • correct information that is wrong or incomplete;
  • delete your information, unless the law requires us to keep it;
  • stop using your information for a particular purpose;
  • withdraw any consent you have given, at any time.

Write to us at the address in clause 13. We respond within 30 days. We may ask you to confirm your identity first. There is no charge.

12Changes to this policy

If we change this policy, we will publish the new version here and update the date at the top. If a change affects how we use information you have already given us, we will tell you directly where we can.
